These are the Digital Product Terms (Terms) of Anneliis Way (ABN 11 074 346 879) (whom may also be referred to in these Terms as “we”, “us”, “our”). These Terms govern the purchase of and access to the digital hypnotherapy program and associated materials made available by us (Digital Products).

By purchasing or accessing the Digital Products, you agree to be bound by these Terms. If you do not agree with these Terms, do not purchase or access the Digital Products.

These Terms should be read together with our Website Terms of Use and Privacy Policy. To the extent of any inconsistency, these Terms will prevail in respect of the Digital Products.

Our Digital Products

1. Our current Digital Products comprise a recorded hypnotherapy program designed to support nervous system regulation (the Program). The Program includes the following components:

(a) Seven (7) hypnotherapy audio and/or video recordings;

(b) A companion guide; and

2. Upon successful purchase, you will be granted access to the members' portal on our website, from which you may download or stream the recordings and access the companion guide.

3. We may update, modify, or supplement the content of the Digital Products from time to time. Where we make any material changes to the Program, we will endeavour to provide you with reasonable notice.

4. The name of the Program is: Regulate.

Critical Health and Safety Disclaimer

5. The Digital Products contain hypnotherapy recordings designed to support nervous system regulation and general wellbeing only. They are NOT a medical treatment and are NOT a substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment.

6. The Digital Products are NOT SUITABLE for persons who:

(a) Have epilepsy or seizure disorders: do not use these recordings if you have, or suspect you have, epilepsy or any seizure disorder;

(b) Have a history of psychosis, schizophrenia, or other serious psychiatric conditions: do not use these recordings if you have a history of, or have been diagnosed with, psychosis, schizophrenia, or any other serious psychiatric condition;

(c) Have dissociative identity disorder (DID) or other dissociative conditions: do not use these recordings if you have been diagnosed with or experience dissociative conditions. This contraindication is of particular relevance to recorded and unmonitored hypnotherapy content;

(d) Are currently under the influence of alcohol or drugs: do not listen to recordings while under the influence of alcohol or any psychoactive substance;

(e) Are under 18 years of age: these recordings are not intended for use by persons under the age of 18 years;

(f) Are currently driving or operating machinery: DO NOT listen to these recordings while driving, operating heavy machinery, or operating any equipment that requires your full attention. Doing so may be dangerous and you do so at your own risk.

(g) Have any other contraindicated condition: if your treating health professional has advised that hypnotherapy is contraindicated for you, do not use these recordings.

7. If you are unsure whether any of the above conditions apply to you, we strongly recommend that you consult a registered medical practitioner before purchasing or accessing the Digital Products.

8. By purchasing the Digital Products, you confirm that:

(a) None of the above contraindications apply to you; or

(b) You have obtained prior medical clearance from a registered health professional to use hypnotherapy recordings

9. Individual results will vary. We make no guarantee of any particular outcome or result from use of the Digital Products.

Purchaser and Access

10. The Digital Products are available for purchase through our website at www.anneliisway.com

11. Upon successful payment, you will be granted access to the members' portal on the website, from which you may access the Digital Products as described in these Terms.

12. Access to the member’s portal, including access to the Digital Products, requires you to create a registered account. You must create your account and accept these Terms of Use before purchasing or using any portal content.

13. You must be at least 18 years of age to create an account and purchase access to the portal. By registering, you confirm that you meet this requirement. If you are under 18, you must not create an account or access the portal without the express consent of a parent or legal guardian, who must also accept these Terms of Use on your behalf.

14. When creating your account, you must provide accurate, complete and current information, including your name and a valid email address. You agree to update your account information promptly if any of it changes. We reserve the right to refuse registration or cancel an account where we have reasonable grounds to do so, including where information provided is inaccurate, incomplete or misleading, or where registration would breach these Terms of Use or applicable law.

15. You are responsible for all activity that occurs on your account where that activity results from your failure to keep your login credentials secure or from your breach of these Terms of Use. If you become aware of any unauthorised access to your account or any suspected security breach, you must notify us immediately at hello@anneliisway.com. We will not be liable for any loss or damage arising from unauthorised use of your account where that use results from your failure to keep your credentials secure.

16. You are responsible for ensuring you have a compatible device, a stable internet connection, and any software or applications required to access and use the portal. We do not guarantee that the portal will be compatible with all devices, operating systems or browsers. Material technical requirements will be disclosed on our website before purchase.

17. Your access to the Digital Products is personal and non-transferable. You must not share your login credentials, access link, or any other means of access with any other person.

18. We reserve the right to suspend or terminate your access to the Digital Products, without refund, if you breach these Terms or misuse the Digital Products in any way.

19. You may close your account at any time by contacting us at hello@anneliisway.com. On closure:

(a) Your streaming access will end immediately;

(b) You will retain access to downloaded content; and

(c) We will handle your personal information in accordance with our Privacy Policy, including our obligations regarding retention and deletion of health information.

Fees and Payment

20. The price for the Digital Products is as displayed on our website at the time of purchase. We reserve the right to amend pricing at any time; however, any price change will not affect a purchase already completed.

21. All prices are in Australian dollars (AUD) and are inclusive of Goods and Services Tax (GST) where applicable.

22. Payment is processed securely through a third-party payment provider. We do not store your credit or debit card details.

Refund Policy

23. Due to the digital nature of the Digital Products, we do not offer refunds once you have clicked the account-creation link provided in your welcome email and have otherwise created or accessed your members account, except as required by Australian Consumer Law.

24. If you have purchased the Digital Products but have not yet clicked the account-creation link provided in your welcome email and have not otherwise created or accessed your members account, you may request a refund within 3 days of the date of purchase by contacting us at hello@anneliisway.com. We will assess your request and respond within a reasonable time.

25. Nothing in this clause limits or excludes your rights under the Australian Consumer Law, including your right to a remedy where a Digital Product is not of acceptable quality or does not match its description.

Licence and Permitted Use

26. Upon purchase, we grant you a limited, non-exclusive, non-transferable, personal licence to access and use the Digital Products solely for your own personal, non-commercial purposes.

27. You must not, without our prior written consent:

(a) Copy, reproduce, or duplicate any part of the Digital Products;

(b) Distribute, share, transmit, or otherwise make the Digital Products available to any third party;

(d) Use the Digital Products for any commercial purpose, including but not limited to teaching, training, coaching, or resale;

(e) Modify, adapt, translate, or create any derivative works based on the Digital Products; or

(f) Remove, alter, or obscure any copyright notice, watermark, or other proprietary marking from the Digital Products.

28. Any unauthorised use of the Digital Products may constitute an infringement of our intellectual property rights and may expose you to civil and/or criminal liability. We reserve the right to take appropriate legal action in respect of any such infringement.

Intellectual Property

29. All Digital Products, including but not limited to the hypnotherapy recordings, companion guide, email content, and all associated materials, are our intellectual property and are protected by Australian and international copyright laws.

30. Nothing in these Terms transfers any intellectual property rights to you. Your purchase grants you a limited licence only, as described in these Terms.

Email Communications

31. The supporting email sequence with reflection questions forms part of the Digital Products. These emails will be sent to the email address provided at the time of purchase.

32. You may opt out of receiving these emails at any time by clicking the unsubscribe link contained in any email, or by contacting us at hello@anneliisway.com.

33. Opting out of the email sequence does not affect your access to the other components of the Digital Products.

Disclaimer and Limitation of Liability

34. The Digital Products are provided on an 'as is' basis. To the maximum extent permitted by law, we make no representations or warranties of any kind, express or implied, as to the suitability, reliability, availability, timeliness, or accuracy of the Digital Products for any particular purpose.

35. To the maximum extent permitted by applicable law, we exclude all liability for any loss, damage, or injury (including indirect, consequential, or incidental loss) arising from or in connection with your access to or use of the Digital Products, including loss arising from reliance on information contained in the Digital Products.

36. Nothing in these Terms limits or excludes any rights you may have under the Australian Consumer Law that cannot be excluded by agreement.

37. Where our liability cannot be excluded, our liability is limited, at our election, to the resupply of the Digital Products or a refund of the purchase price paid by you.

Technical Issues

38. We will take reasonable steps to ensure that the Digital Products are accessible and functioning. However, we do not guarantee uninterrupted, error-free, or continuous access to the Digital Products or the members' area of the website.

39. We will not be liable for any technical difficulties, interruptions, or failure of the website or the Digital Products that are beyond our reasonable control.

40. If you experience technical difficulties accessing the Digital Products, please contact us at hello@anneliisway.com and we will endeavour to assist you.

Entire agreement

41. These Terms form the entire agreement between the parties in respect of the subject matter of these Terms and supersedes all prior agreements, understandings, undertakings and negotiations in respect of the matters dealt with in these Terms.

Variation

42. We reserve our right to change these Terms at any time without prior notice to you. Your continued use of the Services will constitute acceptance of any amended terms and conditions.

Severability

43. If any part of these terms is held to be illegal, invalid, or unenforceable by a Court of law, the legality, validity, and enforceability of the remaining parts will not be affected.

Waiver

44. Any failure or delay by us to enforce any provision of these terms will not be interpreted as a waiver of our rights or remedies.

Governing Law

45. These Terms are governed by the laws of the State of South Australia, Australia.

46. You consent to the exclusive jurisdiction of the courts of the State of South Australia in respect of any dispute arising out of or in connection with these Terms or the Digital Products.
